Service Terms and Conditions
Effective as of July 2020
1. Interpretation
Contractor – JPS Plumbing and Property and/or its authorised agents
Client – Person or Company requesting works to be assumed by the Contractor
Works – Project requested by the Client to be assumed by the Contractor
Price – The quotations provided by the Contractor as agreed upon by the Client subject to variations.
2. Standard of Work
JPS will conduct all works with attention and skill to ensue all works comply with AS 3500, Sydney Waters Code of Practice and NSW Master Plumbers Code of Practice. All materials supplied by JPS Plumbing and Property will be fit for the purpose in which they are supplied. Where possible, JPS Plumbing and Property will ensure all materials have manufacturer’s warranty available.
3. Variations
Works to be carried out may be varied by agreement between Client and Contractor, or by relevant authority. Should this occur, cost of works may be increased or decreased in accordance to JPS Plumbing and Property’s rates of labour and material, or where the price results in a “lump sum” the addition or deduction will be issued to the Client.
4. Site Conditions
The Contractor will issue a quote following an inspection or the site in which the works are to be carried out. If the Contactor encounters conditions in which a site inspection could not be reasonably conducted causing an increase to the original quotation, a price variation will be provided to the Client.
5. Time
The Contractor will commence works on the specified Start Date and complete all works on or before the requested End Date. Where there is a delay beyond the Contractors control, and the Contractor has been prevented from beginning or completing the requested works, for any longer than 28 days, the contractor may terminate the contract. All expenses incurred by the Contractor up to the date of termination will be paid out by the Client to the Contractor.
6. Warranty
The Contractor will remedy any defects on his workmanship for a period if 12 months after the work has bene completed. Where possible, JPS Plumbing and Property will ensure all materials have manufacturer’s warranty available.
7. Working Hours
Business hours is considered to be between 7:00 am and 3:00 pm Monday to Friday (excluding public holidays). Any works carried out outside of these hours will be charged for at penalty rates and will be quoted as a variation to the contract.
8. Payment
The contractor will create progress clams for the value of work completed. The Client will pay the contractor the full amount of each progress claim, including his final claim within 30 days of the issue date. The Contractor shall not make a progress claim, which would bring the amount actually paid beyond the value of the completed work.
If the Client fails to pay the amount of any progress claim or any part thereof within 30 days of the date thereof, the contractor may stop the work until the progress claim has been paid in full.
